Top Criminal Barrister Helping Defendants Attain Bail

Mr Vullo is one of the UK’s top criminal barristers and helps those facing serious criminal allegations attain bail whilst they await trial.

The issue of bail arises in every case, and in more serious matters, the police often detain individuals in custody before their first court appearance. Bail decisions are frequently contested, often on the grounds that further offences may be committed or that the accused may fail to attend future hearings.

It is vitally important for a defendant to present a strong and well-prepared application at the first opportunity. This means putting forward a robust bail package — such as an address away from the complainant (particularly relevant in sexual offence cases where the parties are known to one another) and the inclusion of sureties who can offer financial guarantees if the defendant absconds.

There is often understandable pressure from clients and their families to make a bail application as soon as possible, particularly when someone is in custody for the first time. However, weak or rushed applications — often made by inexperienced lawyers — are more likely to fail. If bail is refused initially, it becomes significantly harder to succeed on a second application, even with improved conditions.

Stephen always advises clients to be patient and to make the strongest possible application the first time around. Once granted, and if the defendant complies with bail conditions, there is usually no reason for bail to be revoked unless something adverse occurs. A successful bail application can mean remaining on bail throughout the entire proceedings without further issue.
